Terms of Service

Effective [DD Month YYYY]

The rules for using the service, in plain words. By creating an account or using the lab, you accept them.

1. Who you are dealing with

The service is operated by Arial d.o.o. (“we”). Contact details are in the Imprint.

2. What the service is, and what it is not

The service adds an invisible mark to images you upload, issues marked copies for the recipients you name, and scans images to find out whether they carry your mark and which copy they came from. It can also seal your registrations with independent timestamps and, if you choose, search the web for your images.

The service is in an invitation-only pilot. Features may change, be limited or be withdrawn while we test it.

It is a technical tool, not legal advice. A scan result, a report or a timestamp is information you can use; whether it is enough for a claim, a dispute or a court is for you and your lawyer to judge.

3. Results are not a guarantee

No mark survives every possible change. A copy can be damaged beyond reading, cropped too far, redrawn by AI or never marked in the first place. Every result states what was found, says so when a reading is less certain than usual, and says so plainly when nothing was found. We do not guarantee that a mark will be found in every copy, that a result is free of error, or that the service will find every place where an image has been published.

4. Your account

  • You need an invite code to register. One account per person or organisation, with true details.
  • Keep your password to yourself. You are responsible for what happens in your account.
  • You must be at least 16.

5. Only images you have the right to mark

You may upload and mark only images that you own or are allowed to mark, and issue copies only to people you are entitled to send them to. You may not use the service to claim someone else’s image as yours, to mark an image that already carries another owner’s mark, or to track people in a way the law does not allow. If you break this, you are responsible for the consequences, and we may close the account.

You keep all rights to your images. You give us only the permission we need to store, process and mark them to provide the service to you.

6. Fair use

You may not:

  • try to break into, overload or reverse-engineer the service or the mark, or help others do so;
  • send automated requests beyond normal use, or work around the limits of the lab;
  • upload illegal content, or content you have no right to process.

Testing the mark in the lab, as the lab invites you to, is of course allowed.

7. Scans of other people’s images

Anyone with an account can scan any image. If an image you scan belongs to another account, the owner receives the file you scanned and the result, without your identity (see the Privacy Policy, section 7). Do not scan files you are not allowed to share for this purpose.

8. Price

The pilot is free of charge. If we introduce paid plans, we will tell you in advance, and nothing will be charged without your agreement.

9. Liability

We provide the service with care, but as it is: in a pilot, without a promise of uninterrupted availability or of any particular result. As far as the law allows, we are not liable for indirect damage, lost profit, or loss caused by a result that was wrong or not found. Liability for intent and gross negligence, and any liability that the law does not allow to be excluded, remains unaffected.

Keep your own copies of your originals. The service is not a backup.

10. Ending

You can stop using the service and ask us to delete your account at any time. We may suspend or close an account that breaks these terms, and may end the pilot with reasonable notice; before that, you will be able to download your marked copies and proofs.

11. Changes

We may update these terms. For significant changes we will tell account holders by e-mail before they apply.

12. Law and courts

These terms are governed by the law of [Country whose law applies, e.g. Switzerland]. Courts at [Place of jurisdiction, e.g. Zurich] have jurisdiction, unless consumer protection law gives you the right to go to court where you live.
